Medical Malpractice Lawsuit Filed For Negligent Surgery

A woman has filed a lawsuit in Cook County alleging medical malpractice. The suit claims that the woman was injured internally as well as externally because of surgery that she did not consent to. The lawsuit further claims that the injuries are permanent and will require future medical treatments. The suit seeks damages in excess of $50,000. In cases where a doctor was negligent in providing care, patients should consult with an experienced medical malpractice attorney to learn what options are available.

Woman Did Not Consent
Thousands of surgeries are completed every day; however, patients must consent to the treatment before it can be provided. Typically, doctors explain the surgical treatment as well as the possibilities that could occur during surgery. Patients must then provide written consent to perform the various treatments and procedures. Doctors must make decisions during the surgery – many of which may be life-threatening. In this case, the woman claims that the doctors did not properly get her consent before surgery. The surgical procedure apparently did not have an acceptable outcome.

Mastectomy Surgery Gone Wrong
The woman in this case underwent mastectomy surgery at the University of Chicago Medical Center. Mastectomy is surgery to remove a portion or all of the breasts. It is often done in the treatment of cancer or as a pre-cancer preventative measure. According to the documents, the woman later underwent a series of reconstructive breast surgeries which she did not authorize. The woman was permanently injured as a result of the procedures. The lawsuit alleges malpractice as well as battery.

Medical Malpractice Lawsuits
Many patients every year suffer injuries as a result of medical procedures that were not performed properly. While the outcome of surgery is not always certain, patients should expect that they are treated with care and that the surgeon what is necessary in every case. When a doctor does not provide proper care it may be considered medical malpractice. In this case, the lawsuit allegations go a step beyond that to claim battery. Battery is an action that causes pain or inflicts harm to another. The lawsuit names not only the medical center, but also the medical team that performed the procedures.

Standard of Care
Medical professionals are required to perform their duties to provide a high level of care. The standard for doctors and surgeons is higher than that of non-professional citizens because they have a high degree of education and experience. As patients, we expect our physician to know the right thing to do and to perform their actions in the best way possible. When this does not occur, the result can cause injuries that range from mild to severe, and indeed, death can happen. When a doctor is negligent in his or her medical duties it may be medical malpractice. Those who were seriously harmed because of medical malpractice may be owed compensation for damages that include such things as medical costs, pain and suffering, and loss of enjoyment of life, among others.
