Botched Cosmetic Procedure Prompts Lawsuit

Cosmetic surgery should be considered safe and those who undergo a procedure expect that it will be completed properly and safely. Unfortunately, a cosmetic procedure went wrong for one local woman, who suffered severe injuries after the procedure was done. The woman has filed a medical malpractice lawsuit against the medical group alleging that they were negligent in using the wrong materials in her procedure. The lawsuit seeks damages of more than $50,000 and is requesting a jury trial.

Bioplasty Gone Wrong

Many different types of cosmetic procedures are available to enhance or improve the body. A bioplasty is a cosmetic procedure used mainly to enhance the buttocks.. During the procedure either prosthetic inserts or some type of material is injected to increase the size of the buttocks. While this type of procedure is usually safe, there are sometimes problems that can occur, particularly when the doctor is negligent. In this case, the woman suffered pain and bleeding after the procedure and the area became infected.

Proper Care Must Be Used

Doctors and other medical professionals must use proper care when performing their activities. In this case, the lawsuit claims that the materials used in the augmentation were not approved by the FDA and were not safe. Further, the doctor failed to consult with a specialist before performing the procedure. The failure of the doctor to take the necessary precautions to prevent injury constitutes negligence. When a doctor is negligent it is commonly called medical malpractice.

Post-Operative Pain and Infection

After an operation is complete the healing process should begin immediately. Some pain is often normal; however, excessive pain may indicate a problem. Severe pain may be a sign of infection. An infection can occur rather quickly, especially if the post-procedure care was not sufficient. In this instance, an infection did become evident. The woman claims that the procedure was not performed properly and that the materials used caused the infection to occur.

Medical Malpractice

Malpractice is the negligent actions, or lack or actions, by a doctor. The doctor is required to know more about medical issues than an average person and therefore must take proper steps to ensure that a problem does not occur. Medical mistakes are quite common. The CDC has determined that medical mistakes are the third leading cause of death in the United States. This is an alarming statistic because these are deaths that could have been prevented had the proper care been provided. Many more medical mistakes happen, but some of them do not cause severe injuries. The woman in this case did, however, suffer severe injuries as well as pain and suffering.

Seeking Justice after Medical Malpractice

Those who are victims of medical malpractice may have suffered a varying degree of injuries. Sometimes the injuries may be minor and the patient will recover rather quickly. But in many situations, the patient has been seriously harmed and may require extensive medical treatment including ongoing surgery and care. Some victims will be permanently disabled while others may actually die as a result of medical malpractice. If you or a loved one were harmed because of the mistake of a doctor, contact Levin & Perconti to learn how to seek the justice you deserve.
