Improper Treatment of Broken Leg Caused Further Injury, Lawsuit

The parents of a boy injured due to surgical mistakes have filed a lawsuit against the doctor and others. The boy suffered a broken leg which required surgery. The parents allege that the boy’s leg was not properly treated and that he was permanently harmed due to negligent care. The complaint was filed in Cook County against Illinois Bone and Joint Institute LLC, Northwest Community Hospital, and doctors seeking damages of more than $50,000 and requesting a jury trial.

Treatment of Broken Bones

Broken bones, especially those in the leg, must be properly treated to prevent further damage from occurring. In children, a broken leg often requires surgical treatment to ensure that the bones heal in proper alignment. Proper alignment is necessary to make sure that the bone will grow at the same rate as the other leg. Another concern when surgery is required is injury to the nerves. Nerve injury may be permanent.

Nerve Injury

Nerve injury can occur when surgery is improperly done or when not enough care is taken. Some of the nerves in the leg or foot can be irreparably damaged during the surgical procedure. This may result in loss of feeling in part of all of the extremity involved. For example, some of the toes or the top of the foot may not have feeling, could feel numb, or may be painful. In this case, the parents state that the boy suffered permanent nerve damage.

Surgical Errors Made

Doctors must take precautions to ensure that there is no damage to the surrounding nerves during surgery. If damage occurs there is likely no way to repair it. In some cases the patient may regain some feeling in the affected area while in other situations, the outcome is less hopeful. The patient may never have feeling return in the area and in severe cases it could impact the victim’s ability to walk without a limp. When a surgeon does not take the care necessary to prevent nerve damage the patient could end up with lifelong injuries.

Medical Malpractice

Medical mistakes can occur at any time during diagnosis or treatment. Medical errors are the third most common cause of death in the United States. When a patient is seriously injured due to a surgical mistake it may be considered medical malpractice. The doctor or hospital may be liable for the damages that were caused by a mistake or error in treatment or diagnosis. The boy in this case is the victim of surgical negligence which caused a severe injury. The lawsuit alleges that the doctors should have prevented the injury from happening. The family is requesting compensation to cover the medical costs that were incurred as well as money for pain and suffering and likely ongoing treatment and permanent disability. Those who are victims of medical malpractice may incur substantial medical bills both now and in the future. If your family member was hurt because of the mistake of a doctor, call the legal team at Levin & Perconti to discuss your claim.
