Colostomy Mistake Caused Injuries, Lawsuit

When we have medical problems we count on the doctor to properly diagnose it and provide us with proper treatment. Unfortunately, sometimes a physician makes a mistake and causes additional pain and further injuries. In one recent case, a patient alleges that the doctor and hospital were negligent by causing serious injuries resulting from mistakes made during or after a colostomy. The man filed a lawsuit in Cook County against Little Company of Mary Hospital and Health Care Centers and two doctors alleging negligence in medical care.

Colostomy Mistake

A colostomy is a surgical procedure that removes a section of colon and redirects fecal matter outside the body into a bag. The removal of a portion of colon is done when the area is diseased or cancerous. The procedure is sometimes done as a temporary measure when further surgery is needed. The man claims that the doctors failed to take the proper steps prior to performing the procedure, including the failure to take a CT scan before surgery.

Failure to Follow Medical Procedures

Doctors should follow the accepted medical procedures before, during, and after surgery. In this instance, the doctor did not order or review a CT scan, a special type of x-ray that helps view internal organs. Had the proper scan been requested and reviewed, it is possible that a colostomy would not have been considered the best medical option for the patient. When a doctor does not provide proper care and the patient is injured as a result, it may be considered medical malpractice.

Medical Errors

Although most of us trust that our doctors always provide us with proper care, unfortunately mistakes do happen. In fact, medical mistakes are now the third most common cause of death in the United States. This is an alarming statistic considering that mistakes are preventable. Mistakes may happen in many areas of care including diagnosis, prescriptions, medication administration, and surgery to name just a few. Medical errors also include the failure to do something that should have been done.

Prevention of Medical Mistakes

Medical mistakes can and should be prevented. Doctors and other medical staff must take care to ensure that they always follow proper procedures and do everything possible to avoid errors. Some of the problems with poor medical care may be the result of overwork and understaffing. Patients should seek a second opinion before undergoing surgery or other major medical treatment. In addition, the proper tests should be completed and reviewed. Doctors should provide patients with their available options based on a thorough diagnosis. If a mistake was made that caused an injury the patient or his family may be entitled to compensation.

When a patient was seriously injured or died as a result of a medical mistake the patient or his family may make a claim for damages.
