Dentist Faces Lawsuit for Root Canal Went Wrong

A Chicago dentist is facing a lawsuit after he performed a root canal that ended up going terribly wrong. A root canal is never pleasant, but for one woman, the experience left her injured and in pain. The woman filed a lawsuit against the negligent dentist claiming the treatment was below the professional standard that is considered acceptable for dentists in Illinois. The lawsuit seeks damage of more than $50,000 and a jury trial has been requested.

Negligent Dental Care
This case brings to light the fact that medical malpractice can occur even with dental services. In this incident, the woman visited the dental office to undergo a root canal procedure. The dentist did not note any problems at the time of the visit. After the surgery, the woman began to experience severe pain, which she reported as being excruciating. The pain would not subside and it was reported to the dentist. In fact, the woman made ten visits to the dentist and the pain continued to go unresolved.

Unresolved Pain Led to Discovery
Finally, the woman sought dental treatment at another dentist who found that a piece of dental instrument was left in the tooth canal. The area was covered with a filling, which was inadequately completed. A small piece of the instrument had come off during the procedure and remained inside, causing the continued pain. The woman states that she suffered not only physical pain, but also emotional distress due to the mistake. While the mistake should not have happened, the dentist failed to properly diagnose the source of the woman’s pain and was negligent in his mistreatment, according to the lawsuit.

Dental Malpractice
Dentists are held to the same professional standards as physicians and other medical professionals. They are expected to have the knowledge, training, and experience necessary to properly diagnose and treat patients. When a dentist fails to do so, the result may be medical malpractice. In this situation, the woman tried to get the dentist to resolve the pain and fix the problem, yet it went on for many months. Even after repeatedly telling the dentist about the pain, nothing was done. In fact, the dentist continually told the woman that the pain would go away.

Medical Malpractice Lawsuit
The woman in this case has filed a lawsuit naming two dentists who both work at the same dental practice. Damages from this incident include money for dental and medical expenses, compensation for pain and suffering, and other damages that typically include legal fees. When a dental or medical procedure goes wrong and someone is injured, the victim is entitled to recover money for expenses caused by the injury. In this case, the woman had severe pain for a year and required dental surgery to remove the foreign object and perform the dental work again. If you suffered a severe injury because of the negligence of a dentist, you need to seek legal assistance. Contact Levin & Perconti for a free consultation today.
